Fairwise Coaches LTD (Customer) Booking Terms and Conditions Last Updated: August 2024

By booking a tour or travel package with Fairwise Coaches LTD, you (the “Customer”) agree to the following terms and conditions. These terms are designed to ensure clarity and fairness for both parties.

1. Booking and Payment Terms:
Booking Confirmation To confirm your booking, a deposit of [insert percentage or amount] is required at the time of booking. This deposit is nonrefundable unless otherwise specified.

Final Payment: The remaining balance must be paid in full [insert number of days] days before the departure date. Failure to pay the balance by the due date may result in the cancellation of your booking and forfeiture of your deposit.

Cancellation by the Customer If you wish to cancel your booking, you must notify us in writing as soon as possible. The following cancellation fees apply:

More than 60 days before departure: 50% of the total cost will be refunded. Between 59 and 32 days before departure: 25% of the total cost will be refunded. Less than 31 days before departure: No refund will be provided.

Cancellation by Fairwise Coaches LTD: In the unlikely event that we need to cancel your booking due to unforeseen circumstances (such as force majeure, insufficient participants, etc.), you will be entitled to a full refund of all payments made or a credit towards future travel, at your discretion.

Changes to Your Booking: If you need to make changes to your booking, please contact us immediately. We
will do our best to accommodate your request, but changes may incur additional fees depending on the nature of the change and the time of notice provided.

3. Travel Insurance
Mandatory Travel Insurance All customers are required to have valid travel insurance that covers medical expenses, personal injury, and cancellations. Proof of insurance must be provided before departure. Fairwise Coaches LTD is not responsible for any costs incurred due to lack of insurance.

4. Health, Safety, and Special Requirements

Health and Fitness: You must be in good health and physical condition to participate in the tour. It is your responsibility to ensure that you are medically fit to travel and participate in the activities outlined in the itinerary. Please inform us of any medical conditions or special requirements at the time of booking.

Dietary Requirements: We will make every effort to accommodate specific dietary needs (e.g., vegetarian, vegan, Jain, gluten-free). Please notify us of any dietary restrictions at the time of booking.

COVID-19 Policy: All customers must comply with the health and safety regulations in place at the time of travel, including COVID-19 guidelines. This may include providing proof of vaccination, negative tests, or adhering to local quarantine requirements. Failure to comply may result in denied entry to certain destinations without refund.

5. Accommodation and Transportation:

Accommodation: Fairwise Coaches LTD will arrange accommodation as per the agreed itinerary. Accommodation standards may vary by location and availability. Special requests (e.g., specific room types) are subject to availability and may incur additional charges.

Transportation: We provide comfortable transportation as per your package, including private coaches, flights, and transfers where applicable. While we strive to maintain the schedule, delays due to weather, traffic, or mechanical issues may occur. We are not liable for any resulting inconvenience.

6. Responsibility and Liability

Fairwise Coaches LTD Responsibility: Fairwise Coaches LTD acts as an intermediary between customers and various suppliers (e.g., hotels, airlines, transportation providers). We carefully select these suppliers but do not have direct control over their operations. Therefore, Fairwise Coaches LTD is not liable for any injury, damage, loss, delay, or inconvenience caused by third-party suppliers.

Customer Responsibility: It is the customer’s responsibility to ensure they hold the necessary travel documents, including passports, visas, and any required entry permits. We are not liable for any issues arising from inadequate documentation or non-compliance with local regulations.

Force Majeure: Fairwise Coaches LTD shall not be liable for any failure to perform its obligations where such failure is due to unforeseen events beyond its control, including but not limited to natural disasters, pandemics, strikes, war, or government restrictions.

7. Behaviour and Conduct

Customer Conduct: Customers are expected to behave respectfully and comply with the laws and customs of the countries they are visiting. We reserve the right to terminate the
participation of any individual whose behaviour is deemed disruptive, abusive, or dangerous to others without a refund.

8. Complaints and Disputes

Complaints Procedure: If you have a complaint during your trip, please inform your tour manager or contact us directly so we can address the issue promptly. We will make every effort to resolve your complaint to your satisfaction.

Governing Law: These terms and conditions are governed by the laws of England and Wales. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

Changes to Terms and Conditions: Fairwise Coaches LTD reserves the right to update or modify these terms and conditions at any time. Any changes will be communicated to customers and will apply to all bookings made after the date of the update.

Price Changes After Booking: Once your booking is confirmed, we will not increase the price except in the case of government-imposed taxes, significant increases in transportation costs, or other external factors beyond our control. In such cases, we will notify you immediately and give you the option to cancel with a full refund or pay the difference.

14. Children and Minors

17. Unused Services: No Refunds for Unused Services Once the tour has commenced, no refunds will be provided for any unused services, including but not limited to accommodation, meals, transfers, or excursions that are voluntarily not used by the customer.

18. Baggage and Personal Belongings

Baggage Allowance: Baggage allowances are subject to the policies of the airline or other transportation providers. Please check these policies prior to departure. Fairwise Coaches LTD is not responsible for any fees incurred due to excess or oversized baggage.

Lost or Damaged Baggage: Fairwise Coaches LTD is not responsible for the loss, damage, or delay of personal belongings during travel. We recommend
ensuring your travel insurance covers such incidents.

19. Photography and Marketing: Use of Photography By booking a tour with Fairwise Coaches LTD, you consent to the use of any photographs or videos taken during the tour for promotional purposes, including but not limited to our website, social media, and brochures. If you do not wish to be featured in our promotional materials, please inform us prior to the tour.

20. Amendments and Modifications by Fairwise Coaches LTD

Tour Itinerary Changes: Fairwise Coaches LTD reserves the right to modify or amend itineraries due to unforeseen circumstances, including but not limited to weather conditions, supplier issues, or safety concerns.
